Terms of Use

1. Acceptance of Terms

By downloading, installing, or using Track on Build ("App"), operated by Epikyklos P.C. ("we," "our," or "us"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

Track on Build is a mobile application designed to help construction professionals and their clients:

• Track construction project progress
• Document work with photos and notes
• Communicate updates between team members
• Manage project timelines and milestones

3. Account Registration

3.1 Account Creation

To use the App, you must create an account by providing a valid email address and display name. You may also sign in using Google Sign-In on supported platforms.

3.2 Account Responsibilities

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use

3.3 Project Access

Access to specific projects is controlled through project codes provided by your project administrator. You may only access projects for which you have been authorized.

4. Acceptable Use

4.1 You Agree To:

• Use the App only for lawful purposes related to construction project management
• Provide accurate and truthful information
• Respect the intellectual property rights of others
• Maintain the confidentiality of project information

4.2 You Agree NOT To:

• Share your account credentials with unauthorized users
• Upload content that is illegal, harmful, or violates others' rights
• Attempt to access projects or data you are not authorized to view
• Interfere with or disrupt the App's functionality
• Reverse engineer or attempt to extract the source code
• Use the App for any purpose other than construction project management

5. User Content

5.1 Your Content

You retain ownership of all photos, notes, and other content you upload to the App ("User Content"). By uploading User Content, you grant us a limited license to store, display, and share it with authorized project team members.

5.2 Content Responsibility

You are solely responsible for your User Content and must ensure you have the right to upload it. Do not upload:

• Content that infringes on intellectual property rights
• Confidential information belonging to others
• Personal information of individuals without their consent
• Inappropriate, offensive, or illegal content

5.3 Content Removal

We reserve the right to remove any User Content that violates these Terms or applicable law.

6. Intellectual Property

The App, including its design, features, and underlying code, is owned by us and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or other proprietary content.

7. Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.

8. Disclaimers

8.2 No Guarantee

We do not guarantee that:

• The App will be uninterrupted or error-free
• Defects will be corrected
• The App is free of viruses or harmful components
• The results of using the App will meet your requirements

8.3 Construction Decisions

The App is a project management tool only. All construction decisions should be made by qualified professionals. We are not responsible for construction outcomes, safety issues, or project results.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

10. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses (including legal fees) arising from your use of the App, your User Content, or your violation of these Terms.

11. Termination

11.1 By You

You may stop using the App at any time and request account deletion by contacting us.

11.2 By Us

We may suspend or terminate your access to the App at any time, with or without cause, with or without notice. Reasons for termination may include:

• Violation of these Terms
• Conduct that we believe is harmful to other users or the App
• Extended periods of inactivity

12. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms in the App. Your continued use of the App after changes are posted constitutes acceptance of the modified Terms.

13. General Provisions

13.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the App.

13.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in effect.

13.3 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

13.4 Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.
